See the practical forks between freelance and commercial self-employment routes before you assemble documents or set a moving date.
Begin with status, not paperwork
The route depends first on where you are, your nationality, and whether you already hold German residence permission. Some nationalities can enter Germany and apply locally; many people must obtain a national visa before travel. A current permit may or may not allow self-employment. Confirm this with the relevant German mission or Ausländerbehörde before relying on a general sequence.
Name the intended activity precisely
Germany distinguishes liberal professions (freie Berufe) from commercial activity that normally requires a Gewerbeanmeldung. Job titles alone do not settle the issue. Qualifications, actual tasks, professional law, and the tax office’s view all matter.
Common planning evidence includes: a CV and qualifications, work samples where relevant, letters showing client interest, a revenue and financing view, health-insurance evidence, accommodation information, and any required professional permission.
Compare the two broad residence frames
Freelance residence permit — §21(5)
Often considered for artistic, teaching, writing, scientific, medical, legal, tax-advisory, engineering, and other qualifying independent professions. The exact occupation and any regulated-profession rules deserve close attention.
Commercial self-employment — §21(1)
Usually calls for a more developed business case addressing economic interest or regional need, likely positive economic effects, and secured financing. The authority examines the whole proposal; a business registration alone does not establish a residence right.
Put the decisions in sequence
- Confirm where the application must be made.
- Describe the work and test whether professional recognition is relevant.
- Identify the plausible residence framing and official local checklist.
- Build evidence of demand, viability, financing, insurance, and qualifications.
- Keep authority fees, processing uncertainty, and a fallback timeline in the plan.
- After the residence step, sequence Anmeldung, tax registration, insurance, and any trade registration.
Where specialist advice belongs
Use a German immigration lawyer for refusals, complex status changes, criminal or asylum history, family-right interactions, and legal interpretation. Use a tax adviser for income-tax treatment, VAT, bookkeeping, and the tax office’s classification. A recognition adviser or competent chamber may be necessary for regulated work.
