Freiberufler or Gewerbe: why the label affects your preparation
Understand the distinction between liberal-profession freelance work and commercial activity when planning self-employment in Germany.
A person can call themselves a freelancer in everyday English while German administration asks a more specific question: is the activity a liberal profession (freier Beruf) or a commercial trade (Gewerbe)?
The distinction reaches beyond vocabulary
The classification can affect trade registration, trade tax, chamber membership, bookkeeping, and the evidence used in a residence application. It is tied to the real activity, not simply the wording on a website or invoice.
Traditional liberal professions include certain scientific, artistic, teaching, medical, legal, technical, and advisory occupations. Some are regulated and require recognised qualifications or permission. Newer and mixed occupations require closer analysis.
Describe tasks, qualifications, and clients
Instead of beginning with a preferred label, write down what you actually deliver, the training or creative authorship involved, who decides how the work is performed, and how you charge. Separate materially different activities. A translator who also runs a language school may have more than one classification question.
The tax office ultimately assesses tax classification. Residence authorities separately decide whether the proposed activity supports the requested permit. Ask each professional or authority the question within its remit.
Do not build the route on a guess
Before collecting dozens of documents, check current guidance from the destination city’s authority, the federal portal, and—where needed—a Steuerberater or lawyer. A clear activity description makes those conversations much more productive.
